Etherion Solutions provides AI-powered business automation services including, but not limited to:

• AI receptionist and inbound call handling services (ARRS — AI Revenue Recovery System)
• Appointment reminders and booking confirmation notifications via SMS
• Lead alert and missed-call follow-up notifications via SMS
• Outbound call qualification and warm lead transfer services
• CRM integration and workflow automation

2. SMS Opt-In and Consent

By providing your phone number and agreeing to receive SMS messages from Etherion Solutions, you expressly consent to receive text messages as described in these Terms. Consent is not a condition of purchase or service.

You may opt into our SMS program through the following method:

• Verbally confirming opt-in during a call with our AI system or a team member, followed by replying YES to a confirmation SMS sent immediately after the call.

We maintain records of all consent for compliance purposes.

3. Opt-Out Instructions

You may opt out of our SMS messaging program at any time using any of the following methods:

• Reply STOP to any SMS message you receive from us
• Email us at support@etherionsolutions.com with your phone number and request to opt out
• Contact us directly at the information provided in Section 11

Upon opting out, you will receive one final confirmation SMS and no further messages will be sent to your number. If you later wish to re-enroll, you may do so by texting START or contacting us.

• Interfere with or disrupt our services or servers
• Attempt to gain unauthorized access to any part of our services
• Use our services for unsolicited bulk communications

We strive to maintain continuous availability of our services but do not guarantee uninterrupted access. Our services may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control including carrier outages or third-party service disruptions. We are not liable for any loss or inconvenience resulting from temporary service unavailability.

All content, technology, software, processes, and materials comprising the Etherion Solutions platform and services are owned by Etherion Solutions or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our proprietary materials without express written permission.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be error-free, uninterrupted, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Etherion Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of revenue, loss of data, or business interruption, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from your use of our services shall not exceed the amounts paid by you to us in the three months preceding the claim.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in Orange County, California, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
